My client, R. Margut, sustained significant personal injuries when she fell as a result of your insured’s negligence. On Marh 7, 20__, Ms. Margut was forced to walk down stairs in the garage as the result of the garage elevator being out of service. As Ms. Margut descended the stairs, she slipped and fell on water that had accumulated due to the rain, seriously injuring herself. The building maintenance personnel and the Board of Directors knew that the garage elevator frequently did not function. It was obsolete and should have been replaced years ago.
The building is filled with senior citizens. They should have to use the dangerous steps, rather than a safe elevator. It is difficult for many people over 80 to go up and down stairs.
After the incident Ms. Margut went to Aventura Hospital where she was diagnosed with an impacted fracture involving the proximal humerus at the level of the surgical neck. She was referred to Dr. Ronnie Arad at Aventura Orthopedics. She also was treated by Dr. Thomas Cronan at Advanced Therapeutic Care, Inc.
Aventura Hospital - $5,711.00
Given the likelihood of a Plaintiff’s verdict and the significant damages, demand is hereby made in the amount of $175,000 as a settlement of Mrs. Marrgut’s claims against The Hallmark of Hollywood Association, Inc.
