Undue Influence and Confidential Relationships

Contesting a will in Florida involves raising objections to the validity of a will, based on the assertion that the Will either does not reflect the actual intent of the party who made the Will or the Will was prepared without the formalities required by law. However, most Will contests generally focus on the idea that the creator of the will lacked testamentary capacity or was subject to undue influence or fraud.

Undue influence normally arises where a beneficiary under the will stands in a confidential relationship with the testator. A will may be challenged in its entirety, or only in part.

In a will contest the estate has the initial burden of proving the formal execution and attestation of the will. Once the estate’s done that, the burden of proof then shifts over to the party contesting the Florida Will.
