Florida Arbitration and Mediation Attorney
Arbitration and mediation are increasingly used in resolving disputes allowing individuals and businesses to resolve their legal issues without having to go through the time and expense of the traditional litigation process. Sackrin & Tolchinsky advise their clients to consider the use of these alternative dispute resolution (ADR) options because they are intended to be less expensive and speedier than a legal trial.
The lawyers at Sackrin & Tolchinsky have represented clients in a wide variety of mediation and arbitration cases over their combine 48 years of experience. During the arbitration and/or mediation process, we present our client’s case in a clear and logical manner and we thoughtfully analyze the facts and law involved in the situation. Our goal is to help our clients move past a dispute while preserving business relationships and avoiding excessive court costs.
What are Arbitration and Mediation?
Arbitration is not litigation. Instead, both parties present their cases to an agreed-upon third party arbitrator (or, in some cases, more than one arbitrator) who reviews all the evidence and renders a decision. The decision of the arbitrator is generally legally binding, with limited recourse to litigation after an unfavorable decision. This makes it important for parties to hire knowledgeable legal counsel because of limited court review.
Mediations are sometimes contractually required, or the parties may agree jointly to try to resolve their disputes through mediation. Mediation allows both parties to be a part of a negotiation to try to resolve their dispute. If the parties are unable to reach an agreement through mediation, they may move to arbitration, or take the matter to court. The option to mediate is available to parties in the middle of litigation or may occur prior to litigation.
